NOTICE OF FORECLOSURE
GEORGIA, EMANUEL COUNTY.
WHEREAS, heretofore on December
18, 2006, Mark Hudson did deliver
to Durden Banking Company, Inc., a
Deed to Secure Debt conveying the
following described land, to-wit:
All that tract or parcel of land lying
situate and being in the 1452nd G. M.
District of Emanuel County, Georgia
containing One and Five Hundred

One One-Thousandths (1.501) acres,
more or less as shown on that particular
plat of survey prepared by A. G.
Wells, Jr., Surveyor, dated February 20,
2001, which is recorded in Plat Book
18, Page 530, of the Records of the Office
of Clerk, Emanuel County Superior
Court. Said plat by reference hereto
is incorporated herein for a more full,
complete and accurate description of
said property. Said tract of land is
bounded now or formerly as follows:
North by Flint Lake Road; East by
Coiston Road; South by lands now or
formerly of Johnny Coiston; and West

Williams.
The above described tract of land
is the same as that conveyed to Mark
Hudson by Warranty Deed from James

would be evidenced by a note or notes,

WHEREAS, the debt secured by

among other possible events of default,
failure to pay the indebtedness
as and when due and in the manner

as required by O.C.G.A. Ann. {44- 14-
162 through 44-14-162.4 (Michie 1982).
Now therefore according to the
original terms of said Deed to Secure
Debt and the laws in such cases made
and provided, the undersigned will expose
for sale to the highest and best
bidder for cash, the property described
in said Deed to Secure Debt from
Mark Hudson to Durden Banking
Company, Inc., after proper advertisement
on the first Tuesday in October,
2007, between legal hours of sale before

On the 6th day of August 1996, ALBERT
WILLIAMS, JR., and THERSA
A. WILLIAMS, ("Williams") executed a
Note and Deed to Secure Debt for
$176,652.00 payable to Jim Walter
Homes, Inc., conveying property described
in Exhibit "A" attached, and
recorded in the Office of the Clerk of
Superior Court of Emanuel County,
Georgia, in Deed Book 88, Page 70.
Said Note and Deed to Secure Debt
were subsequently assigned to William
J. Wade, not in his individual capacity,
but solely in his capacity as trustee for
Mid-State Trust VI and Walter Mortgage
Company, ("Wade and Walter") by
assignment dated July 13, 2007, and
recorded in aforesaid Clerk's Office.
Default has been made in the installment
payments due for April 2007,

Inc. by assignment; the undersigned,
Mortgage Electronic Registration Systems,
Inc. pursuant to said deed and
the note thereby secured, has declared
the entire amount of said indebtedness
due and payable and pursuant to the
power of sale contained in said deed,
will on the first Tuesday in October,
2007, during the legal hours of sale, at
the Courthouse door in Emanuel County,

All that tract or parcel of land lying,
situate, and being in the 53rd G.M. District

Park Subdivision, as shown by a plat
made by Frank J. Ford, Surveyor, in
February, 1957, and recorded in the Office
of Clerk of the Superior Court of
Emanuel County, Georgia, in Plat Book
1, Page 2, and said plat is by this reference
made a part hereof.
Said Lots 1 and 2 in Block O are
more particularly described as follows:
beginning at a concrete monument at
the intersection of Arden Drive and
Azelea Circle and having a frontage of
150 feet on the South side of Azelea
Circle (also known as Azelea Drive)
and a depth of 293.8 feet between parallel
lines and along the West side of Arden
Drive to the North lines of Lot 29
in Block O.
which has the property address of
240 Arden Drive, Swainsboro, Georgia.,
together with all fixtures and other
personal property conveyed by said
deed.
The sale will be held subject to any
unpaid taxes, assessments, rights-ofway,
easements, protective covenants
or restrictions, liens, and other superior
matters of record which may affect said
property.
The sale will be conducted subject
(1) to confirmation that the sale is not
prohibited under the U.S. Bankruptcy
Code and (2) to final confirmation and
audit of the status of the loan with the
holder of the security deed.
Notice has been given of intention
to collect attorneys' fees in accordance
with the terms of the note secured by
said deed.
Said property will be sold as the
property of Norma S. Woods and Terry
Ray Woods and the proceeds of said
sale will be applied to the payment of
said indebtedness, the expense of said
sale, all as provided in said deed, and
the undersigned will execute a deed to
the purchaser as provided in the aforementioned
Security Deed.

court an action to quiet title to the real
estate more particularly described as

lying and being in the 1502nd
GMD of Emanuel County, Georgia,
containing 42.8 acres of land, more or
less, and being more particularly
shown on a plat of survey prepared by
Lamar O. Reddick, Surveyor, dated October
16, 1979, title "Survey for Nola
Bell McLeod" and recorded in Plat
Book 12, Page 26, Emanuel County
Clerk's Records, and referred to herein
for a more full and complete description.

Any and all persons claiming an interest

26, 2007, CATINIA LOTT WORTHEN
did deliver to SHELLIE LOUIS, a Deed
to Secure Debt conveying the land described
in Schedule "A" below; And,
WHEREAS, said Deed to Secure
Debt was executed to secure a Note of

even date therewith between CATINIA
LOTT WORTHEN to SHELLIE LOUIS
in the original amount of $38,000.00, including
any renewals thereof which
was or would be evidenced by a Note
or Notes, which is shown by said Deed
to Secure Debt recorded in the Office
of Clerk, Emanuel County Superior
Court, in Deed Book 284, Pages 266-269;
And,
WHEREAS, said Note was due and
payable in monthly installments which
are past due and SHELLIE LOUIS has
elected to accelerate payment of said
Note; And,
WHEREAS, notice has been given
as required by O.C.G.A. 44-14-162
through 44-14-163.4 (MICHIE 1982).
NOW THEREFORE, according to
the original terms of said Deed to Secure
Debt and the laws in such cases
made and provided, the undersigned
will expose for sale to the highest and
best bidder for cash, the property described
in said Deed to Secure Debt
from CATINIA LOTT WORTHEN to
SHELLIE LOUIS, after proper advertisement,
on the first Tuesday in October,
2007, to-wit: October 2, 2007, between
the legal hours of sale before the
courthouse door in Swainsboro,
Emanuel County, Georgia. Said sale
will be subject to any outstanding prior
Deeds to Secure Debt, Ad Valorem taxes,
and the purchaser will be responsible
for any Georgia Real Estate Transfer
Tax. Proceeds from said sale will be
used first, to pay the cost and expense
of said sale; second, to pay the balance
on the indebtedness mentioned above
due by CATINIA LOTT WORTHEN,
and third, to pay the surplus, if any, to
the person or persons legally entitled
